Unique Fit Terms and Conditions of Membership
General
- You will be given a free key fob with your membership. Should you require a replacement, a fee of £10 will be charged.
- Membership does not guarantee the availability of a parking space. Parking spaces are available on a first come first served basis.
- Members must keep their personal details up to date at all times. Any changes should be made known to the on site coach(s) or at reception or via email to theteam@uniquefit.co.uk
- Smoking (including e-cigarettes) is not permitted.
- Food and chewing gum are not permitted within the gym area.
- We ask you to familiarise yourself with the contents of our signs, notices on display and the location of the emergency exits.
- You are required to use discretion on the use of cameras, video and mobile phones. Always ask permission regarding taking of pictures and social media updates when it involves Unique Fit or any members.
- All valuables and personal possessions are the responsibility of the owner. Unique Fit cannot take responsibility of any valuables or personal possessions ( on site in the club)of its members
- You cannot transfer this membership to anyone else nor transfer to another date.
- There may be occasions where we have to close all, or part of, the gym. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
- We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
Gym Use
- You must sign in / scan into the club upon entry. We must know who is on site and when they arrived for safety of all members in the event of an emergency, fire, evacuation of the building.
- Gym induction is compulsory upon becoming a member of Unique Fit. The induction training must be booked via reception and consists of five one to one circuit workouts with a Unique Fit coach.
- Please use the gym equipment / hydraulic resistance machines and stretch cage as you were trained to by the coach’s. Do not attempt to use the resistance machines or stretch cage in any other way that the way you were trained to.
- Do not attempt to / or to move the hydraulic gym machines, recovery stations, stretch cage or any cv equipment i.e. bike, running machine, cross trainer or stepper.
- Please put any exercise equipment back in the original place e.g. dumbbells back on their rack, floor mats rolled and put away
- Please use all gym equipment as you have been instructed to. If you do not know how to use such equipment, please ask an on duty coach or enquire about assistance at reception.
- Any malfunctioning or deemed unsafe equipment be reported to reception or onsite coach(s) immediately they are noticed.
- Should you feel unwell, breathless, dizzy, heart palpitations or have any other health issue please stop exercising and report your condition to the on-duty coach(s) or reception.
- Should there be any changes to your health or personal circumstances as pertaining to the membership of Unique Fit please inform us immediately. This can be done via reception, directly with an on-duty coach, via email at theteam@uniquefit.co.uk or calling us on 07305 072718.
- Appropriate attire should be worn on the circuit and in the gym. For example: footwear should be trainers or similar style shoes (no heels or sandals or bare feet), clothes such as jogging bottoms, leggings t shirts, sweatshirts, vests.
- Failure to adhere to these rules may result in the termination of your membership.
- Any injuries or accidents will be noted in the accident book and first aid provided where necessary in accordance with Health and Safety.
Gym Membership (11-17 yrs)
- £25 per month, no joining fee.
- Must be accompanied at all times by a parent/ guardian who must have a current membership.
- Gym induction is compulsory before using the gym independently. This can be booked at reception and will require five one to one personal sessions to familiarise with the hydraulic machine use
- All other gym etiquette and general membership rules applies to gym membership (11-15 yrs) users.
Annual
If you pay for an Annual Membership i.e 12 months membership fees in advance, your membership will run for the 12-month period covered by the payment without any refund should you choose not to use your membership in that 12 month period.
Pro rata refunds will be provided with 1 month’s notification of cancellation. This can be provided via email at theteam@uniqwuefit.co.uk If you received a discount for paying upfront for 12 months membership this discount will be removed and the full value of the membership will be pro rata charged for the time you have used the membership prior to cancellation.
Principal Terms
- This agreement commences once you have indicated your acceptance in the signature section of this form.
- Your membership starts immediately.
- You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
- The Joining Fee / Initial Payment is due from you to us, is payable immediately and is not refundable other than in the event of breach or negligence by us.
- The Direct Debit Payment Amount is due from you to us. The first one being paid on the 1st Direct Debit Payment Date and then every month thereafter. You are obligated to make every Direct Debit Payment regardless of nonattendance, except where the cancellation terms below are met.
- If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £25 (which we require to cover our costs of seeking to pursue such payment from you).
- You agree to advise us promptly of any change to the Members Details provided.
- If you fail to pay any amount due under this agreement for a period of more than thirty days, then we will cancel your membership.
- To cancel your membership, you should give us not less than 30 days’ notice. When the final minimum period payment has been taken you should also cancel your Direct Debit mandate directly with your bank. Failure to do so could incur further payments to us that cannot be refunded.
- After the final payment has been taken you should also cancel your Direct Debit mandate directly with your bank.
- 3 Month Minimum Contract on all rolling Direct Debits. Unless cancellations fall within the below terms (12-16.)
- Relocation: This agreement can be cancelled if your new permanent address is more than 15 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.
- Long term (over 3 month) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.
- Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.
- Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given. Please note – ANY Cancellation for the above reasons will not be affected until the appropriate proof is provided and received (in writing or via email theteam@uniquefit.co.uk) by the club.
- Breach: This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services, you may reasonably expect and we have fallen well below that standard.
- As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights.
- This agreement is governed by English Law.
FREEZING
- Temporary Illness or Injury: This agreement may be frozen in the event of a temporary illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period. There will be no rejoining fee levied if the member returns to the club within 6 months of the freeze.
Please note – ANY Freeze will not be affected until the appropriate proof is provided and received by the club.
General Terms
- You agree to comply with the Terms of Membership which are written in this terms and conditions document as relate to the use and operation of the gym / club Unique Fit. We may make reasonable changes to these conditions at any time provided we give you reasonable advance notice of the change.
- If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
- We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.
- We will do our best to resolve any disputes over this agreement. If you wish to take court proceedings against us you must do so within the United Kingdom. Relevant UK law will apply.
- If any part of this agreement is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply
- We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules (i.e. Stealing or other criminal activities within the facility). In this event you will not be liable to pay any further Direct Debit Payments, provided such breach is not deemed by us to have occurred primarily to qualify you for a refund.
- To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.
